What does the Company Tax in Spain entitle?

The Spanish Constitution of December 27, 1978, provides in Article 31 that we all should contribute to the maintenance of public expenditure according to our economic capacity.

One of the most direct definition of “economic capacity” of a person is the  total income that is perceived, measured over a period of time. When income is obtained by individuals, the Spanish tax system does called Spanish Income Tax (IRPF- Impuesto sobre la renta de las personas físicas).

However, if the income is generated by a legal entity (company, association, foundation, etc..), than instead of Income tax we would call it  Company Tax (I.S. Impuestos sobre sociedades). In this sense, the company tax in Spain is complementary to the Income Tax of Individuals. Read more »

Specifically chapter two of the mentioned law is including relevant reductions in the Spanish tax system. Of course, limitations on these reductions have been mentioned as well.

1).- The Directors of your Company must approve an agreement stating the setting up of the branch in Spain, as well as appointing a legal representative who shall be resident in Spain.

2).- The mentioned agreement for the setting up of the branch, appointment of the representative in Spain and By Laws for the company, will have to be legalised and translated into Spanish by a Sworn translator.

3).-The social capital approved by the Mother Company will have to be deposited in Spain, when the branch counts with capital endowment.

 In May the number of foreign contributors to the Social Security system grew by 31,264 workers, or 1.83%. It is the third month in a row there has been a rise after eight months of declines. May is usually a month when the number of foreign contributors grows due to agricultural work and the tourist season.

The Minister for the Treasury and Public Administration Services, Cristóbal Montoro, stated on Monday in the Upper House, that faced with a critical and crucial period for the Spanish and European economy, “more Europe, more Euro, more structural reforms and more budgetary stability are the path to exit the crisis”, together with “adequate financing as a result of European integration, through the ECB, which must respond with firmness and consistency to the pressures of the markets which are still trying to create barriers to the development of the common project that is the Euro”.
